Alexey Pertsev, a developer involved with the Tornado Cash cryptocurrency mixing service, is facing a critical juncture in his legal fight and urgently needs additional financial support. Arrested two years ago, Pertsev is contending with significant legal expenses as he appeals a court ruling in the Netherlands. His legal team has estimated that they require between $750,000 and $1 million to cover ongoing costs, emphasizing the necessity for continued financial backing to mount an effective defense as outlined via a tweet on  X.

Pertsev’s case has attracted widespread attention within the cryptocurrency community and from digital privacy advocates. This case has become a focal point in the ongoing debate about the legal and ethical implications of developing such technologies.

Pertsev’s legal troubles began in August 2022 when the U.S. Treasury imposed sanctions on Tornado Cash. Additionally, the service was accused of being used to facilitate money laundering by various entities. Including North Korea’s Lazarus Group, which is linked to the $625 million Axie Infinity hack. On May 14, 2024, the ‘s-Hertogenbosch Court of Appeal in the Netherlands sentenced Pertsev to five years and four months in prison, citing his involvement in laundering $1.2 billion through Tornado Cash. This sentence came after a previous ruling in November 2023. When a Dutch court denied Pertsev’s request for release under surveillance.

Despite his defense team’s efforts, the court rejected the argument. That Pertsev should not be held liable for the actions of individuals who used Tornado Cash for illicit purposes. During his trial in March 2024, Pertsev’s lawyers contended that the developer could not have foreseen or prevented the misuse of the protocol. However, the court dismissed these claims. Additionally, asserting that Pertsev and his co-founders could have taken more proactive measures to prevent such criminal activities.

Ongoing Financial Struggles and the Role of JusticeDAO

As Pertsev continues to serve his sentence, his legal team faces mounting financial challenges. The complexities of the case deepened by Pertsev’s lack of access to essential digital resources. Recently, Pertsev’s request to use a computer to assist in his defense was denied, adding another layer of difficulty to an already challenging situation.

In response to the financial strain. JusticeDAO, an advocacy group formed to support Pertsev and his co-developer, Roman Storm, has been actively raising funds. By June 19, 2024, JusticeDAO had managed to raise over 654 Ether, equivalent to approximately $1.7 million for the current Ether price, through a campaign titled “Free Alexey & Roman” on the decentralized platform Juicebox. To ensure transparency. Juicebox has made a publicly accessible spreadsheet available that tracks all expenses related to the “Free Alexey & Roman” fund. Moreover, having spent $1.39 million on legal fees from December 2023 to May 2024 underscores the significant financial burden associated with Pertsev’s defense.
